Fresno Pacific University reserves the right to process student conduct violations administratively. Generally, an Administrative Review (AR) is reserved situations where the immediate health, safety and reputation of the Respondent or other involved parties may be of added concern. Fresno Pacific University, may also, at its discretion, allow students to request an AR rather than one of the other options available within the disciplinary process. An AR is generally conducted by a Conduct Administrator from the Division of Student Life, or an adjudication panel of trained faculty or staff. Based on a preponderance of the evidence standard, the Conduct Administrator or adjudication panel will determine responsibility for the alleged violation(s). Relevant evidence including statements made to employees of FPU, witnesses, and other involved parties may be used to determine the outcome of an AR. The respondent may also be asked to participate in an AR to provide their perspective and statement of the event(s). However, attendance at the AR by the Respondent is not required to determine the outcome. If the Respondent is found to be responsible for the alleged violation(s), the Conduct Administrator or adjudication panel will establish a Restorative Discipline Plan/Corrective Measures. *In the case of an AR for a Student-Athlete entering the Safe Harbor Program, an Agreement & Supportive Measures will be established by the Conduct Administrator or their designee.
Should the behavior of a student be deemed counter to the education process, and/or harmful or dangerous to other students/faculty/staff, Fresno Pacific University reserves the right to remove that student from particular settings related to Fresno Pacific University (i.e. the institution, a class, a team, or a residence) pending the outcome of the disciplinary process.
Additionally, an administrative review may be held in lieu of standard procedures for violations occurring in the last two weeks of the semester in order to resolve a case prior to students leaving for Christmas or summer break.
Prior to an AR the Respondent will be provided, in writing for level 2 or higher alleged violations, notice of the allegations. Upon completion of an administrative review, the Respondent will be notified in writing a Notice of Determination, including a finding and any corrective measures, if appropriate. Results of Administrative Reviews may come from the entire range of options noted in the section “Restorative Discipline Plans.”
